PhotoPort Terms of Service
These Terms govern your use of the PhotoPort website, macOS app, licenses, free trial, backend services, and related support from Blackpepper Ltd.

Short version
- PhotoPort performs one-way sync from Apple Photos to Google Photos under your control.
- You are responsible for choosing what to sync and for having the rights and storage capacity needed for your media.
- The free trial allows up to 500 uploaded media items. One photo or one video counts as one media item.
- Website licenses and Mac App Store purchases are separate unless we explicitly say otherwise.
- PhotoPort is provided as-is, and you should keep your own backups of important media.
1. Who we are
PhotoPort is operated by Blackpepper Ltd. You can contact us through the PhotoPort support form.
These Terms apply to photoport.app, the PhotoPort macOS app, backend services used for OAuth token exchange, licensing, trial usage, app integrity, and any related documentation or support.
2. Acceptance of these Terms
By downloading, installing, purchasing, registering, or using PhotoPort, you agree to these Terms and to the PhotoPort Privacy Policy. If you do not agree, do not use PhotoPort.
If you use PhotoPort on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. What PhotoPort does
PhotoPort is a macOS app that uploads media from Apple Photos to your connected Google Photos account. It can sync selected albums, full-library media when that mode is enabled, future albums when supported by your settings, and media that is not in an album.
PhotoPort is designed as one-way sync from Apple Photos to Google Photos. It does not modify or delete your local Apple Photos library.
4. Your responsibilities
- You are responsible for the photos, videos, album names, and other content you choose to sync.
- You must have the rights and permissions needed to upload media to your Google Photos account.
- You are responsible for complying with Apple, Google, payment provider, internet provider, and app store terms that apply to your use.
- You are responsible for maintaining adequate backups of important media and settings.
- You are responsible for reviewing sync selections before clicking Apply Changes.
5. Google Photos, Apple Photos, and third-party services
PhotoPort works with Apple Photos, Google Photos, Google OAuth, Google Photos APIs, Google Drive storage quota metadata, payment processors, app stores, hosting providers, and email providers. Those services are controlled by their own providers and may change, limit, suspend, or discontinue features independently of PhotoPort.
Google Photos API uploads count toward your Google Account storage according to Google's policies. PhotoPort may prepare or resize media before upload based on your selected quality setting, but the uploaded files still use Google Account storage.
PhotoPort cannot guarantee that third-party APIs, quotas, app store policies, account settings, library permissions, network conditions, or storage limits will always allow sync to complete immediately.
6. Free trial
PhotoPort may offer a free trial that allows up to 500 uploaded media items. One uploaded photo or one uploaded video counts as one media item.
The trial is measured by completed uploads, not by selected albums. Changing album selections, reinstalling the app, changing computers, or clearing local data may not reset the trial. PhotoPort may use local and backend-backed trial records to enforce the trial limit and prevent abuse.
When the trial limit is reached, PhotoPort may continue to let you sign in, view settings, select albums, and manage preferences, but uploads beyond the trial allowance require a valid license or app store purchase.
7. Licenses, purchases, and activation
A website license unlocks PhotoPort for the direct website build. A Mac App Store purchase unlocks PhotoPort through Apple's purchase system. These purchase channels are separate unless we explicitly provide a transfer or linking option.
Website license keys are for the purchaser's own use and may not be shared, resold, published, rented, or used to bypass licensing limits. We may revoke, suspend, or replace licenses involved in fraud, chargebacks, abuse, unauthorized distribution, or material Terms violations.
PhotoPort may periodically check license status with backend services. If a licensed direct customer is temporarily offline or the backend is temporarily unreachable, PhotoPort may allow a short cached grace period.
8. Payments, taxes, and refund policy
Website purchases may be processed by Stripe or another payment provider. Mac App Store purchases are processed by Apple. Prices, taxes, fees, currency conversion, and payment authorization may be handled by the applicable payment provider or app store.
Website license purchases are final and non-refundable except where a refund is required by law. PhotoPort provides a 500 media-item trial so you can test the app before buying.
If you bought PhotoPort from the website and need help with a license issue, use the PhotoPort support form. If you bought through the Mac App Store, Apple's refund process and App Store rules apply.
9. Acceptable use
You agree not to:
- Use PhotoPort to upload content you do not have rights to upload.
- Use PhotoPort for unlawful, harmful, abusive, or privacy-invasive activity.
- Reverse engineer, modify, bypass, disable, or interfere with licensing, trial enforcement, request signing, security, or sync controls except where law permits.
- Use PhotoPort in a way that overloads, disrupts, or abuses PhotoPort backend services or Google APIs.
- Share license keys, tokens, credentials, or other access mechanisms with unauthorized users.
10. Sync behavior and data deletion
PhotoPort keeps local sync records so it can resume work, avoid repeated uploads, reconcile album mappings, and process deletion or rename settings. If you clear local sync data, PhotoPort may lose local knowledge of previous uploads and may need to rebuild mappings from available Google Photos app-created data.
When you stop syncing an album, PhotoPort may ask whether to keep uploaded content in Google Photos or remove app-uploaded items from the matching PhotoPort-created album. Google Photos APIs may not allow PhotoPort to delete the empty album itself or remove media directly from your Google Photos library in every case.
You can always manage your Google Photos content directly in Google Photos and manage Apple Photos content directly in Apple Photos.
11. Updates and changes
We may update PhotoPort to add, change, or remove features; fix bugs; improve security; comply with platform or API requirements; or support new macOS, Apple Photos, Google Photos, payment, or app store behavior.
We may update these Terms from time to time. If changes are material, we will update this page and, where appropriate, provide additional notice. Continued use of PhotoPort after updated Terms are posted means you accept the updated Terms.
12. Disclaimers
PhotoPort is provided "as is" and "as available." To the maximum extent permitted by law, Blackpepper Ltd. disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, and data loss prevention.
PhotoPort is not a substitute for a complete backup strategy. You should keep separate backups of important photos, videos, libraries, devices, and account data.
13. Limitation of liability
To the maximum extent permitted by law, Blackpepper Ltd. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, goodwill, data, media, or business opportunity; service interruptions; third-party platform changes; Google or Apple account issues; or storage quota consequences.
To the maximum extent permitted by law, Blackpepper Ltd.'s total liability for claims related to PhotoPort is limited to the amount you paid for PhotoPort in the 12 months before the event giving rise to the claim.
14. Termination
You may stop using PhotoPort at any time. We may suspend or terminate access to licenses, backend services, or support if we reasonably believe there is fraud, abuse, security risk, unauthorized license use, chargeback activity, or a material violation of these Terms.
15. Governing law
These Terms are governed by the laws of the United States and the applicable laws of the state where Blackpepper Ltd. is established, without regard to conflict-of-law rules. Some jurisdictions provide consumer rights that cannot be waived; these Terms do not limit those rights.
